Apple Wins Australian Patent Salvo Against Samsung

The patent war between Apple and Samsung produced a major victory for Apple Thursday, and potentially opens a significant legal threat against Android-based devices in a variety of markets. The Federal Court of Australia issued a temporary injunction blocking Samsung from selling its Galaxy Tab 10.1 tablet, thus missing the holiday season there. Although temporary, the injunction will remain at least until the trial is completed, which is expected to be sometime next year. Since the Tab will miss the all-important holiday season, some industry observers are speculating that Samsung will skip the Australian market entirely for this product, even if it were to win the trial. ‘No Coincidence’ On Friday, both companies will appear in the court to determine if a modified version of the Tab 10.1 can be sold without Apple’s objections. In a statement, Samsung said it would continue its legal fight with Apple. The company added that it was “confident” it can successfully fire back at Apple, and prove that its wireless-technology patents have been violated by the maker of the iPhone and the iPad. Samsung is attempting to obtain a ban on Apple’s new iPhone 4S in South Korea, Italy and France, as well as other markets. Apple has also won a preliminary injunction against the Tab 10.1 in Germany, based on design-related intellectual property. In response, Apple said that “it’s no coincidence that Samsung’s latest products look a lot like the iPhone and the iPad, from the shape of the hardware to the user interface and even the packaging.” In the Netherlands, another front in this worldwide war, Samsung has made software changes related to photo scrolling in its Galaxy smartphones in order to avoid an injunction there, which had been requested by Apple. RIM Co-Founder Apologizes, Service ‘Approaching’ Normal

The co-founder of Research In Motion has apologized for his company’s service outage, and said that service levels are “approaching” normal in various markets. However, no estimate was given for when everything would be restored. In a video message on the company’s Web site, Mike Lazaridis said RIM’s goal has been to “provide reliable, real-time communication” worldwide. “We did not deliver on that goal this week,” he said. “Not even close.” He added that the company was now near normal levels in Europe, the Middle East, India and Africa, but noted that “we’ve let many of you down.” Core Switch Failure In a statement on its Web site, RIM said “some customers in Canada and Latin America who are sending messages to other regions may see intermittent message delays,” a situation which was being actively addressed by support teams. The service delays began Monday, and affected BlackBerry customers in India, Africa, the Middle East, Europe, Brazil, Chile and Argentina. On Wednesday, the outage hit users in the U.S. and Canada. On Monday evening, RIM acknowledged via Twitter that some users in Europe, the Middle East, and Africa were “experiencing issues.” The company said later that night that e-mail was back to normal, but that delays persisted for Web browsing and instant messages. On Tuesday, RIM said the cause was a core switch failure in its network in Europe. Report: Apple Readying Movie Cloud Service

As the controversy around Netflix swirls, Apple may be one of the competitors looking to take advantage of the open door. Apple is getting ready to put movies in the cloud, according to a report in the Los Angeles Times. The Times reports that Apple reps have been talking with Hollywood studios to ink deals that would pave the way for consumers to buy movies through iTunes and access them on any Apple device. The Times cited anonymous sources. The service could launch in late 2011 or early 2012. The rumor comes at the intersection of two announcements this week: Apple’s iCloud is live and the Digital Entertainment Content Ecosystem’s UltraViolet service has launched. The DECE is a consortium of Hollywood players that have created an online personal library that gives consumers access to movies and TV shows they purchase. Streaming Content Everywhere UltraViolet and iCloud are fairly similar. Once a movie or TV show has been added to a consumer’s UltraViolet library, consumers have options to stream it over the Internet, download it for offline viewing, or play it back on a disc. Consumers can watch the content on a mobile device, computer, television, gaming console or other enabled device. By way of comparison, Apple’s iCloud lets consumers automatically download new music purchases to all their devices. Consumers can buy a song on the iPad and find it waiting for them on the iPhone with no syncing required. iTunes in iCloud also lets consumers download previously purchased iTunes content, including music and TV shows, at no additional cost. Movies would add a new element to the iCloud mix. The movie studios seem to have plenty of motivation to cooperate with Apple.
